On September 28, 2023, the US Environmental Protection Agency finalized a rule that provides the public with the largest-ever dataset of per- and polyfluoroalkyl substances (PFAS) manufactured in the United States through the Toxic Substances Control Act (TSCA). All entities, regardless of size, that manufactured and/or imported PFAS or PFAS-containing articles since 2011 have until May 8, 2025 to report a panoply of PFAS data. Failure to fully comply and report all reasonably ascertainable information may result in severe penalties and regulatory enforcement actions. This announcement has generated “compliance panic” among the thousands of U.S. companies that manufactured and imported PFAS and PFAS-containing articles of commerce over the past 13 years.
